License And Site Access.  CLBrody Artisanat LLC grants you a limited license to access and make personal use of this website.  You agree not to download (other than page caching) or modify it, or any portion of it without the express written consent of CLBrody Artisanat. This license does not include any resale or commercial use of this site or its contents, any collection and use of any product listings, descriptions, or prices, any derivative use of this site or its contents, any downloading or copying of information for the benefit of another merchant, or any use of data mining, robots, or similar data gathering and extraction tools.  This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of CLBrody Artisanat LLC.  You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of CLBrody Artisanat LLC or any of its websites without the express written consent of CLBrody Artisanat LLC.  You may not use any meta tags or any other "hidden text" utilizing CLBrody Artisanat’s name or trademarks without the express written consent of CLBrody Artisanat LLC.  You acknowledge that any contravention of any of these specific provisions terminates the permission or license granted by CLBrody Artisanat LLC to you for the use of this or any related website for any purpose.

Links.  You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of CLBrody Artisanat.com but not to any other page in this website.  You agree that any such link to this website will not  portray CLBrody Artisanat or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any CLBrody Artisanat logo or other proprietary graphic or trademark as part of the link without the express written permission of CLBrody Artisanat LLC.

Your Email Address or Other Identifying Information.  You agree that you will never use a false e-mail or any other address for purposes of identifying yourself or any other person or entity, impersonate any person or entity, or otherwise mislead any person for any purpose when using any CLBrody Artisanat LLC website, product, or service for any purpose whatsoever. 

Electronic Communications.  When you visit this website or send e-mails or other documents to us through this website, you are communicating with us electronically.  We may likewise do the same with you, specifically with respect to communicating with you by e-mail.  You consent to receive such communications from us electronically, and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications to you be in writing.

Your Account.  If you register to use this website (not a current requirement or option), you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.  CLBrody Artisanat LLC does sell services that may be used by persons under 18 years of age, but it sells them only to adults who can purchase with a credit card or other permitted payment method.  If you are under 18, you may use this website only with involvement of a parent or guardian.  CLBrody Artisanat LLC  reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders made using your account in its sole discretion.

Retainers, Fees, and Payments.  YOU ARE NOT REQUIRED TO PURCHASE ANY PRODUCT OR SERVICE, OR TO PAY ANY FEE, TO USE THIS WEBSITE.  If at any time you elect to purchase any product or service offered on this website, you agree that such purchases are being made for the specific purpose of making repairs and/or restorations to single items that are wholly owned by you and no other party, and that these repairs are being performed by artisans who put themselves forth in that capacity alone and not in any capacity as “handyman”, “carpenter”, “home improvement contractor”, “electrician”, “plumber”, or other role that would be subject to any special or unique craft licensing or permitting by any US federal, state, or municipal authority.  You further acknowledge that any advance payment made by you serves as retainer that will be applied in part to work as it is actually performed on your behalf by CLBrody Artisanat, and in part as a scheduling fee to defray the opportunity costs accruing to CLBrody Artisanat in scheduling and preparing work on your behalf and purchasing materials related thereto.  Your credit/debit card(s) will be billed immediately after you present your card information to us to effect payment for any purpose; any checks you may present as payment will be deposited within 2 business days.  You acknowledge that we do not accept online payments and that payment by you in any form can be made only by mail or directly to one of our representatives and not through any third party.  You agree to pay all fees and charges for any products or services that you purchase that were offered for sale to you by CLBrody Artisanat or by any other vendor or service provider through CLBrody Artisanat.com that has been agreed explicitly by you.  You agree to pay all applicable taxes and shipping charges relating to the purchase of any such products or services.  WE STRONGLY RECOMMEND THAT YOU RETAIN FOR YOUR RECORDS A PRINTED AND/OR COMPUTER-STORED COPY OF ANY RECIEPT FOR ANY PURCHASE YOU MAKE AT THE TIME OF PURCHASE, whether given to you at the time of service rendered or sent to you electronically by us.

Refund Policy.  If for any reason you wish to cancel a CLBrody Artisanat service, you can do so without by calling our service line or sending an email to services@clbrody.com.  In all such cases, you will receive a full refund of any retainer paid for any service less a 5% or $50 cancellation fee (whichever is higher), so long as no actual work has been performed by us.  In all other cases, a pro-rated refund will be made.  No shipping or transportation charges can be refunded in any circumstance.

Digital Millennium Copyright Act Claims.  Pursuant to Title II of the Digital Millennium Copyright Act, all claims of copyright infringement for material that is believed to be residing on CLBrody Artisanat’s system or network should be promptly sent in the form of written notice to CLBrody Artisanat Designated Agent:

All claims must include the following information:

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

Public Reviews, Public Comments, Public Communications, And Other Similar Content.  From time to time, CLBrody Artisanat LLC may make it possible, for example by means of public blogs the access to which would be available on its websites, for visitors to post reviews, comments, photos, and other content specifically intended by the visitor to be viewed by other people using this website, or to submit suggestions, ideas, comments, questions, or other non-personal information.  You agree that if you author such material and submit it to any CLBrody Artisanat LLC website, you will assure that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to CLBrody Artisanat or third parties, or objectionable and that it will not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."  CLBrody Artisanat LLC reserves the right (but not the obligation) to remove or edit such content, but confirms that it may not always review posted content on a scheduled basis.

Right To Use.  If you do post content or submit material explicitly intended for public viewing on such blogs or similar pages of any CLBrody Artisanat LLC website, and unless we indicate otherwise, you grant CLBrody Artisanat LLC a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.  You grant CLBrody Artisanat LLC and its sublicensees the right to use the name that you submit in connection with such content, if you choose.  You represent and warrant that you own or otherwise control all of the rights to the content that you post, that the content is accurate, that use of the content you supply does not violate any Terms stated herein, that it will not cause injury to any person or entity, and that you will indemnify CLBrody Artisanat LLC for all claims resulting from content you supply.  CLBrody Artisanat LLC has the right but not the obligation to monitor and edit or remove any activity or content.  CLBrody Artisanat LLC takes no responsibility and assumes no liability for any content posted by you or any third party.

Applicable Law.  By visiting any website owned and operated by CLBrody Artisanat LLC or purchasing any product or service offered by CLBrody Artisanat LLC, you agree that the laws of the state of Maryland, United States of America, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and CLBrody Artisanat LLC related to those Terms.

Dispute Resolution.  Any dispute relating in any way to your visit to any CLBrody Artisanat LLC website or to products or services sold or distributed by CLBrody Artisanat LLC shall be adjudicated in the applicable state or federal court in Montgomery County or Prince Georges County, Maryland, United States of America, and you consent to exclusive jurisdiction and venue in such courts.

Modification to Site Policies; Severability.  Please review all of our policies posted on this website.  We reserve the right to make changes to our websites, policies, and these Terms at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
